Hotararea Consiliului Local 479/15.12.2009 privind aprobarea Planului Urbanistic Zonal "Locuinte si functiuni complementare", Zona Calea Torontalului, parcelele A 694/5, A 690/1/2, A 690/1/1 extravilan, Timisoara Consiliul Local al Municipiului Timisoara Având în vedere Referatul nr. U22008-6111/18.11.2009 al Primarului Municipiului Timişoara, domnul GHEORGHE CIUHANDU; Având în vedere avizele Comisiei pentru studii, prognoze, economie, buget, finanţe, impozite si taxe, Comisiei pentru dezvoltare urbanistică, amenajarea teritoriului şi patrimoniu, Comisiei pentru administrarea domeniului public si privat, servicii publice şi comerţ, regii autonome şi societăţi comerciale, Comisiei pentru administraţie locală, juridică, ordine publică, drepturile omului şi probleme ale minorităţilor şi al Comisiei pentru cultură, ştiinţă, învăţământ, sănătate, protecţie socială, turism, ecologie, sport şi culte din cadrul Consiliului Local al Municipiului Timişoara; În baza dispoziţiilor Hotărârii Guvernului nr. 525/1996 privind Regulamentul General de Urbanism, republicată; În baza prevederilor Legii nr. 50/1991 privind autorizarea executării lucrărilor de construcţii, republicată şi modificată; În baza prevederilor art. 25 alin. 1 şi Anexei I din Legea nr. 350/2001 privind amenajarea teritoriului şi urbanismul, modificată; Având în vedere Avizul de Oportunitate nr. 01/09.12.2008, aprobat cu Hotărârea Consiliului Local nr. 560/2008 şi de Raportul de Avizare Favorabil nr. 02/PV-12.11.2009 al Comisiei Tehnice de Amenajare a Teritoriului şi de Urbanismism; În conformitate cu prevederile art. 36 alin.2 lit. (c) şi alin.5 lit.(c) din Legea nr.215/2001 privind administraţia publică locală, republicată şi modificată; În temeiul art. 45 alin. 2 din Legea nr.215/2001 privind administraţia publică locală, republicată şi modificată; HOTARASTE Art.1:Se aprobă Planul Urbanistic Zonal "Locuinte si functiuni complementare", Zona Calea Torontalului, parcelele A 694/5, A 690/1/2, A 690/1/1 extravilan, Timisoara, având ca beneficiari pe Sfetcu Marius Marcel, Sfetcu Adrian Mircea, Birosek Elisabeta, Goia Gheorghe, Groza Victoria, întocmit conform Proiectului nr. 40/2007, realizat de S.C. Tectonics House S.R.L., care face parte integrantă din prezenta hotărâre. Art. 2:Se stabilesc condiţiile de construire: - pentru zona de rezidentiala: regimul de înălţime de S+P+2E, POT max de 35%, coeficientul de utilizare al terenului CUT de 1; - pentru zona de dotari: regimul de înălţime de S+P+2E, POT max de 40%, coeficientul de utilizare al terenului CUT de 1,2; accesul auto si realizarea locurilor de parcare se vor face in conformitate cu Avizul Comisiei de Circulatie nr. TH2008-007887/04.12.2008, spaţii verzi de 25% din suprafaţa totală a parcelelor, in conformitate cu Avizul Agentiei de Mediu nr. 3699/13.07.2009. Art.3:Prezentul Plan Urbanistic Zonal "Locuinte si functiuni complementare", Zona Calea Torontalului, parcelele A 694/5, A 690/1/2, A 690/1/1 extravilan, Timisoara, se va integra în prevederile Planului Urbanistic General Timişoara şi are o valabilitate de 5 ani. Terenul studiat, in suprafata totala de 118.000 mp este înscris în: C.F. nr. 412621 (provenită din conversia pe hârtie a C.F. nr. 140568), având nr. Cad A 690/1/1, reprezentand teren arabil extravilan, in suprafata de 53.000 mp, proprietatri Sfetcu Marcel si Sfetcu Adrian Mircea, C.F. nr. 406934 (provenită din conversia pe hârtie a C.F. nr. 118129), nr. cadastral Cad: A 694/5 reprezentând teren arabil extravilan, in sprafata de 41.800 mp, proprietari Birosek Elisabeta, Goia Gheorghe si Groza Victoria, CF nr. 412620 (provenită din conversia pe hârtie a C.F. nr. 140569), nr. cadastral Cad: A 690/1/2 reprezentând teren arabil în extravilan, in suprafata de 17.000 mp, proprietari Sfetcu Marius Marcel si Sfetcu Adrian Mircea. Art. 4:Reglementările privind autorizarea construcţiilor şi a amenajărilor vor fi aplicate în concordanţă cu prevederile prezentului Plan Urbanistic Zonal şi a Regulamentului Local de Urbanism. Autorizatia de construire se va putea elibera dupa reglementarea situatiei juridice a suprafetelor de teren afectate de drumurile propuse prin documentatie. Art. 5:Scoaterea din circuitul agricol si introducerea in intravilan se vor face pe cheltuiala beneficiarilor. Dupa introducerea terenurilor in intravilan acestea vor trece in ZONA B de impozitare, conform principiului stabilit prin Hotărârea Consiliului Local nr. 349/2005. Art.6:Cu aducerea la îndeplinire a prezentei hotărâri se încredinţează Direcţia Urbanism din cadrul Primăriei Municipiului Timişoara. Art.7:Prezenta hotărâre se comunică: - Instituţiei Prefectului Judeţului Timiş; - Primarului Municipiului Timişoara; - Consiliului Judeţean Timiş; - Serviciului Juridic; - Direcţiei Economice; - Direcţiei Edilitare; - Direcţiei Urbanism; - Direcţiei Patrimoniu; - Direcţiei Comunicare; - Direcţiei Drumuri şi Transporturi; - Direcţiei Dezvoltare; - Direcţiei de Mediu; - Biroului Control Intern şi Managementul Calităţii; - Beneficiarilor: Sfetcu Marius Marcel, Sfetcu Adrian Mircea, Birosek Elisabeta, Goia Gheorghe si Groza Victoria; - Proiectantului: S.C. Tectonics House S.R.L. - Mass - media locale.

Asigurarea de conditii pentru eliminarea riscului de poluare a aerului, apei si solului. Asigurarea de conditii pentru diminuarea poluarii fonice datorata vecinatatii aeroportului utilitar(400m) si liniei CFR( 20m)
